I think it's time we looked at the City Building Inspectors responsibility and negligence. My home was constructed without the needed flashings and weep screens. I suffered water damage last fall during a severe wind and rain storm. I can't go after the builder due to Utah's economic loss rule. I am going after the city inspectors. There is a North Dakota Supreme Court opinion that states cities can be held liable for negligent inspection. (North Dakota Supreme Court Opinion, Ficek V Morken, 2004 ND 158, 685 N.W..2d98) We have to keep fighting.... |
