Subject:   The De-Bruceing of Elbert County, (How Concervatives raise taxes)

Message:   On Nov. 5th 1996 The Concervative Elbert County Board of Commissioners (McAndrew, Morrison, & Heinz) placed a question on the ballot to Elbert County residents.
" Shall Elbert County be authorized to retain all revenues from building and other development related fees, exactions and permits; and revenues, cost reimbursements and grants from other governments; during 1996 and each subsequent fiscal year; and shall Elbert County be authorized to spend all such revenues on road improvements, growth management, public safety and such other costs as may be directly related to growth in Elbert County unless otherwise provided by law, agreement, or grant, without regard to any limitation contained in article X, section 20 of the Colorado Constitution or any other law; provided howwever, that no property tax mill levy shall be increased at any time, not shall any new tax be imposed, without the consent of the voters of Elbert County approving any such increase of new tax?"

Sounded Good at the time. Wait a minute fast forward to the 2006 Budget just passed this past December 14th. Due to the County Acessor re-acessing all properties in Elbert County, the property tax revenue generated went up over 10% for the coming year. Go back and find hidden amongst the verbage, " Without regard to limitation contained in Article X, section 20 of the Colorad Constitution (Tabor) or any other Law; (5.5% cap on property tax revenues when reacessed)" So what sounded like we were authorizing the county to spend monies taken in from building permits etc, on roads and bridges is in fact a periodic tax raise, despite the fact that the mill levy can not go up.

I think we should all call out BOCC and remind them that the object stated in the election for keeping the extra monies was first Road and Bridge and Secondly Public Safety. Once those are satisfied then they can use the monies on other priorities.
