Custody of 9 and 16 year old question

I had a question about typical custody agreements. My daughter is 9 and my son is 16. From what I understand, I would be likely that my 9 year old would be with me. My stbx told my 16 year old that he would have to choose which parent to live with. Of course, this upset my son. He was in tears. Who would want to choose between your parents? I know I wouldn't. I told my son that we would work out an arrangement that we felt would work out for him. Because he is older, I told him that his wishes would be taken into account. I also told him that judges typically like to keep siblings together. Am I wrong?

I wanted to take him off the hot seat...take the pressure off of him. Do any of you know how custody is handled with older children...and if they have younger siblings?

Any input is greatly appreciated.

Re: Custody of 9 and 16 year old question

Normally after 14 the court relies heavily on the wishes of the children, if both parents are considered equal. Both caring and loving, both stable homes and food in the cupboards. My judge split the kids, the older children were old enough to deceid and stayed with me, the youngest was not and the ex fought custody for over a year and won.
So the judge will split the kids, it all depends on the attorneys envolved and if they play fair or not. I was labeled a bad mom becasue I worked and he was a stay at home disabled father that could provide better for the child because he was home full time. a bunch of bs, but in the end if this is what is ordered you have no choice but to comply.
