Suzette: I am sorry for all you have been through. My ex shoved me after making a special trip to the bowling alley in an unprovoked attack. You need a Lawyer or Legal Aid for low income people if you are living in poverty. You can also check the following: the local court house, battered women's services center and/or the local bar association. Nicole?
I posted 2 times and it didn't "take"...find an attorney (1st visit usually free) a women's shelter and/or domestic violence hotline. I was married to an abuser for 31 years and the attorney told me that the photos of my bruises could be used in court if need be (it wasn't necessary)..Idon't know the answer to your question, but an attorney can help you. I am so sorry.
Abuse is one factor that the court takes into account in a divorce but it is not dipositive (no "winner" take all as far as I know in most states). It also has to be proven. Same for cheating and all the other crappy things that people do.
If you don't have a lawyer, get one. Go to Legal Aide if you can't afford a lawyer.
