unpaid taxes

HI, I am really struggling with my soon to be ex. We are about to go to trial because I don't agree that I should pay for his unpaid taxes for the last 3 years. He told me that he paid them and now during this divorce he just paid it and his lawyer is claiming he should get half of this back. I quit my job and stayed home with the kids and just recently started working full time. Do I have a case with this? Has anyone else gone through this? Is this worth going to trial?

Talesa: I have been divorced since 2009. During that time there was an "economic stimulus" (money paid out to people) via taxes via the President. We split that and that is what the Lawyers decided upon. It was in the divorce agreement how the taxes should be handled. Ask your Lawyer if there is a cancelled check or some other type of proof/something in writing to prove he paid the taxes just to make sure everything's ok. I wouldn't think anyone would be getting any type of refund(s). If people don't pay their taxes/file on time, there are penalties and interest. It is doubtful there is any refund and I don't think it is worth going to trial over this. If there is a refund, it is generally split between the couple.

If the three years were during the marriage, it is a marital debt. You got the benefit of his income during that period and you are partially responsible for the taxes.
