visitation time with noncustodial parent

My ex-husband has a week of non-interrupted vacation coming up with our two kids. He has to work; however, and will not be spending the entire week with them. When he's a work, his parents keep the kids. I am a teacher and off work during the summers. Due to our summer schedule (50/50), the kids stay with my ex-husbands parents a good deal although I'm home. So, the issue has been that they are with someone other than parents during his week while he's at work. I do not mind the kids being with him when he is there--I just wish they were with me--their mom--while he cannot watch the kids. Does anyone know about this issue? Is there any definition for who the kids can stay with if the parent is unavailable. I know I could go back to court to amend the paperwork to say something about first refusal or being in the actual parent's custody, but just wanted some thoughts and input first...
