17 years ago I was being abused. After I was raped, I testified and put my husband in prison. While he was there, I met someone. He took care of me. Respected me. I fell in love. I married him, knowing full well I was still married. I knew it was wrong. I did not care. A year later, husband #1 passed away from a brain stroke. After 17 years of a hard marriage (he cheated on me twice with HIS ex wife...), I am divorcing husband #2.
My question is this: Is my second marriage void? I divorced my 1st husband, but only AFTER I was already married to my 2nd husband. I know I committed a crime - bigamy - which is illegal in every state. I live in California.
Do I even have to file for divorce from husband #2, or was it void to begin with because I married him while I was still married to husband #1.
