Hi, i need some insights on NJ law. My soon to be ex ( it seems that he wants out) has been living outside of our house. He told me he has substance abuse issue. He went to rehab and now back at work. He makes a lot more money than me. I work, but my income is not steady. I refused to allow him into a house we own and would like to continue to live here, since our son is comfortable here. Until i find a next place to live, i would like to stay in a house. (We would probably have to sell ) Would i get sole and legal child custody ? Of course i have been dropping and picking up our child to and from school, arrange any extra activities, playdate, dr appointments, everything ! He has been verbally abusive towards my child and I. How do i prove that he has been awful, distant father and husband? Thank you for your support.
