My husband and I names are on the mortgage. We filed chpt 7 bankruptcy last year due to him losing his job. He has since established residency elsewhere and we haven't filed yet. Our 2 daughters and I will be keeping the house and I will be assuming all financial responsiblity and maintaining the house. He insists on keeping a key and me not changing the locks. I am legally capable of changing the locks and installing an alarm? And once we file will the divorce decree release him from all financial and legal liabilities if I am willing to assume them all until I am able to refinance the house? Any options or suggestions...PLEASE HELP!!

Honey if he moved out change the locks. He has already indicated that he doesn't want to live there. I changed the locks the first time my ex just walked in before work one morning, I was still sleeping and I woke up to him standing over my bed. "I have the right to be here it's my house" That night there were new locks on every door.
The only thing he can really do is call the cops but if you are seperated then they can't really do anything. My ex tried that. If he comes to the house and won't leave then call the cops yourself and get a PFA against him.
As for the divorce decree, it will say what you agree to. Make sure you want all the debit. Once it is done it is done.
