I am not sure if I can file on behalf of my mother for an annulment. I would like to find out if I can. My mother and her husband married just four months before she passed away. I do not believe that she was wanting to get married. My family and I feel that the only reason "my step-dad" married my mom was because he wanted to keep everything from us. We are struggling to get her belongings to their rightful places. I have been asking since three days after she passed away. Now my sister and I are wanting to file for an annulment on behalf of my mother.
Do I need to contact an attorney for information? Any help would be appreciated at this point.

You can't file an annulment on behalf of a deceased person.
I think you are getting distracted from your main point, the distribution of her estate. Was there a will? If so, then no problem. If not, you need to find an estate attorney in your state because the surviving spouse usually inherits all of the deceased assets, no matter how long the marriage was.
You will get no where by claiming that your mother didn't really want to get married.
