You will need to file for a change of custody in the court. There will be a hearing.

If he has *voluntarily* had no contact for over a year, you should get full legal and physical custody. What kind of custody orders are in effect now? If you have primary physical custody, there is essentially no difference in the time with each of you. I think you are asking to have his joint legal custody revoked so that you can make all decisions.

Child support will be unaffected. If you have him most of the time now, you are probably receiving the maximum under your state guidelines. It is unlikely to go up, but will not go down if both of your financial situations are unchanged.

Note that if he asks for visitation at the hearing, he will receive it, but from your description, he is not exercising the visitation that he has. That is terrible for your son.
