Divorce property settlement question

I'm looking to file for divorce . I was married in the Philippines in 1996. I've been "separated" since 2004. I moved to NJ in2006. My spouse still currently lives in the Philppines.We have 1 son, and he never paid child support, as he's unemployed all these years. However, I bought a condominium last year here in NJ, which he doesn't have any part of. If I file for divorce now, will he have part of the condo equity or my retirement plan? I know he won't sign a quitclaim. Please help.

Not sure about your state laws, but here in Illinois, unless you are legally separated, your spouse has a right to everything accrued during your marriage...together or apart. Check on your state laws.

Now in PA anything after date of separation ( I left in may so anything he bought in june I am not entitled to) is NOT considered marital asset.
Also in most cases it is 10 years of marriage and then he is entitled to a % of the retirement
