Did I make a mistake? I left my husband almost a year ago to move from cali to Ny. I started filing for divorce in September and to avoid him getting my 401k I withdrew it all that December. I took a big tax and penalty hit on it. He still has not signed any divorce agreements yet. Am I in the clear or could he come after me financially?
Yes you are liable for paying him half. Misappropriation of funds or wasting. Best thing is to wait it out and hope he doesn’t sign or have him cancel the divorce if he does till things clear. There was previously a 5 year look back but it
May now only be 2 years. My soon to be ex wife did this and my attorney said she had to put it back or pay half. Divorce will be inevitable at this point.
