Non Qualified Pension Distribution

Company went bankrupt before the Non Qualified Pension could be divided. After 10 years it is now paying out. Ex spouse was the employee, we both had a claim but they paid it out under his claim only. He insisted on not using the court appointed tax attorney at time of judgement and is calculating what tax I owe him and deducting it from said payout. Can he do that? My tax bracket is much much lower than his. We were married 26 years and he worked for the company the whole marriage, I never worked. Any advice would be appreciated.
