Can I get out of state visitation?

My two year old lives in Ca with her dad and I live in Virginia. I moved out here two months ago to look for work and marry again. I have steady income and a house. I also have a 4 month old with my husband. I want to file for visitation. What would my chances be to get 6 months with me 6 months with her dad. I can afford the flying costs.

Re: Can I get out of state visitation?

I doubt you will get 6/6 being that you are so far away. Think of how hard that would be on a 2 year old? You also have to think about when she starts school, you can't have a child in two different school in two different states ( I looked into this when my ex threatened 50/50, he lives in Maryland I live in PA) I don't know the reason(s) that you are so far away but can you and your new husband move closer?
My SIL lived in PA ( moved to CA, literally this morning :( ) and her ex lives in Texas. My niece goes with her Dad for 6 weeks in the summer and 2 weeks during Christmas vacation. My brother and her have to buy the tickets, because she choose to move out of state.
Hope it all works out for you but really put her best interest at heart. That is a long flight for a child.
